Is settlement changing for spouse visa holders?
Quick answer
Proposed, not yet in the rules: a five-year route for partners of British citizens with B2 English, no specified public funds and a household income of at least £25,142, laid from the December 2026 rules at the earliest. From 26 March 2027 the settlement English level rises to B2.
What the rules say
Settlement changes (proposed)
Proposed, not yet in the rules: the government’s November 2026 response on “earned settlement” keeps a five-year route for partners of British citizens, with B2 English, no use of specified public funds and a household income of at least £25,142. The Home Secretary said on 2 November 2026 the changes would begin to be laid from the December immigration rules. None of it changes what is sent for a first visa or an extension today.

The English requirement
The applying partner needs English at A1 (speaking and listening) for the first visa, A2 for the extension and B1 for settlement, from a test taken with an approved provider within the last two years. From 26 March 2027 the settlement level rises to B2. A degree taught in English also meets it: a UK degree certificate, or a degree from abroad with confirmation from Ecctis.

How long the visa lasts
From outside the UK the partner visa is granted for 2 years 9 months, then extended for 2 years 6 months, and settlement (indefinite leave to remain) can be applied for after five years. The fiancé visa lasts six months, with no right to work; after the wedding the couple apply in the UK for the partner visa.
